These terms and conditions govern the provision of air conditioning, ventilation, MVHR, and related HVAC services by Ernest Air Cooling Ltd (Company No. 7735735), trading as Ernest Air Cooling.

1. Definitions

"Company" refers to Ernest Air Cooling Ltd.
"Customer" refers to the person or business commissioning our services.
"Services" refers to air conditioning installation, maintenance, repair, ventilation, MVHR systems, and related HVAC work.
"Quote" refers to the written estimate provided for proposed work.

2. Quotations & Pricing

All quotations are valid for 30 days from the date of issue unless otherwise stated.
Prices quoted are exclusive of VAT unless otherwise specified.
Quotations are based on information provided by the customer. Additional work discovered during installation may incur extra charges, which will be agreed upon before proceeding.
A deposit may be required for larger installation projects, with the balance due upon completion.

3. Booking & Scheduling

Appointments are scheduled subject to availability and confirmed in writing or by phone.
We require at least 48 hours' notice for cancellations or rescheduling. Late cancellations may incur a call-out fee.
The customer must ensure safe and clear access to the work area on the scheduled date.

4. Installation Services

All installations are carried out by F-Gas certified engineers in accordance with current regulations.
The customer is responsible for obtaining any necessary planning permissions or building regulations approvals.
We will advise on requirements but cannot guarantee approval from local authorities.
Standard installations include pipework, cabling, and condensate drainage as specified in the quotation.
Making good of decoration (plastering, painting) is not included unless specifically quoted.

5. Warranties & Guarantees

We offer a 5-year workmanship guarantee on all new installations.
Manufacturer warranties apply to equipment as per their terms and conditions.
Warranties are void if equipment is tampered with, incorrectly used, or not maintained as recommended.
Annual servicing is required to maintain manufacturer warranties on most equipment.

6. Maintenance & Service Agreements

We recommend annual servicing of all air conditioning and ventilation systems.
Maintenance contracts are available and provide priority booking and discounted rates.
Emergency call-outs outside normal business hours may attract additional charges.
Parts and refrigerant are charged separately unless included in a service agreement.

7. Payment Terms

Payment is due upon completion of work unless credit terms have been agreed in writing.
We accept payment by bank transfer, card, or cheque.
For commercial customers, payment terms of 14 or 30 days may be available subject to credit approval.
Late payments may incur interest at 8% above the Bank of England base rate.

8. Liability

Ernest Air Cooling Ltd holds comprehensive public liability insurance.
We are not liable for pre-existing defects, damage caused by customer negligence, or issues arising from equipment not installed by us.
Our liability is limited to the value of the work carried out.
We are not responsible for delays caused by factors outside our control, including supply chain issues or adverse weather.

9. Health & Safety

All work is carried out in compliance with Health & Safety regulations.
Our engineers are trained and hold relevant certifications including F-Gas, NEBOSH, and City & Guilds qualifications.
The customer must inform us of any known hazards or access restrictions at the property.

10. Complaints & Disputes

If you are not satisfied with our work, please contact us within 7 days of completion.
We will investigate all complaints and aim to resolve issues promptly.
In the event of a dispute, we will attempt to reach an amicable resolution before any legal action.

11. Data Protection

Your personal data is handled in accordance with our Privacy Policy and UK GDPR regulations.

12. Changes to Terms

We reserve the right to update these terms and conditions. The current version will always be available on our website.
